e39 540i sport question

I have the chance to pick up a 2003 540i sport for a great price. The only issue the car has is there is a fan that doesnt cut off and therefore drains the battery. The details are vague as this is through my wife, but she mentioned (and I quote), "some relay switch thing that doesnt cut the little fan off." In addition, sometimes the AC does not cut on. My first thoughts are that this is the ac aux fan switch - any ideas here?

Also - any other thoughts about the 2003 540 sport?

If we get the car, the options are to sell my 14 year old e34 with 170k miles or my wifes 8 year old mercury with 50k miles. You get two guesses which one will go...

i just did a 2000 528 today that had a bad aux fan that was drawing the battery down but wasn't running while doing it (pulling about 170ma), dealer on the new one was $241 jobber so over the counter is probably about $300 which ain't bad, i was expecting $5-600 like the older fans were, probably the same fan, the older units had a pair of resistors the new one runs a integrated solid state speed control
