you can download a form from that link, fill it out and fax it to Ebay, worth a shot. but...how can you prove that its your picture?

Jon probably has the picture in raw format, you cant easily change from the thumbnail the ebay site has to a high resolution raw image.

I think it's a compliment, IMHO. If someone was driving by your house, saw your car stopped and took a picture of it and then used that image to sell a product, could you sue them? I don't think so. You own the car not the image. If anything you should be extremely flattered to have such a fine car admired by others.

luck prosecuting. I personally would be flattered. Nothing to be pissed at. If your posting them on the internet in my opinion your asking people to use them anyway. I actually thought about registering copyright for a number of pics and decided the whole point of the internet is to share info anyway and blew it off. I would probably ask the guy for a few freebies since it is my image if i were Jon, but i certainly wouldn't get upset over it.

His response to me:

if you feel that bad about a good well taken picture FREELY available to the whole world i feel sorry for you, please note.

1 i got the picture from the web by running a search on google images and i also have the same picture on a disc i purchased

2 prove to me you own the picture and i will remove it but you will have to stop it being posted on the net because all the world and his dog can use it any time.

i am all to aware of copyright law and would never knowingly infringe anyones copyright but as i poijted out i have the same picture on two seperate sources freely available to the world. i think maybe you should be happy your work has been noted and if you are able to provide me with details and the proofs i will mention you and your work in or on any item produced. but as for loyaltys etc sorry "

the image is clearly visible on www.jonkensy.com under automotive.

Yes you could sue them - you need a property release for any photograph of property that is going to be sold commercially.

Yeah bill I am not too upset about it, it's just stupid that he'd take an image and sell it while not owning the rights. It's on my website, which is copyrighted. He said he received the image on a CD that he "purchased". I would just appreciate he not use my work/property to make profit - I know that picture didn't make me money, and although it's on the internet does not make it public domain.

its like someone posting a writeup with pics about fixing an LKM, and someone taking that, making a brocher, and selling it for profit. maybe its not leagaly wrong, but it seems a bit scumy or somthing like that.

"fair play i take my hat off to you so i can remove it or refere and make note of the due credit both on page and item web address etc , the volume of sale is only a few 3-4 sold. the disc was purchased at a car boot sale so i cant contact the vendor"

Dude great website. Even the......." ALL RIGHTS RESERVED " in the bottom right corner. Goodluck. Contact Ebay, and tell them the situation. They will resolve the problem for you, and make him take off his auctions.

You make more money by letting someone advertise their product for time on end with your picture in it - depending on how long the ad is in print/display you get a decent portion of their gross margin :)

Jon, I looked at your gallery. You really need to put a big copyright notice on those images as I can see this idiot ripping off most of your photos. They are really good!

As for copyright, you own the rights so you can sue, but in the UK you'll end up with the square-root of nothing as we're not into the massive payments for copyright theft that the USA is. I doubt that he's shifting thousands of these so even if you win it will probably cost you more in legal fees.

If you are letting people download these images then you are on dodgy ground, unless you state in the terms and conditions something along the lines of "not for resale of profit".

BTW: If he's sourcing his images from here, I can't wait to see Jeffs (632Regal) "diy chicken" mousemat. Or even better Winfreds "beer hauler"....
