Not with 265/40/18, wrong tire size for the wheel! 265/40/17 might! I believe e39 has offset of 25 for the 17x9 wheel. You might rub inside the tire well. I have 265/35/18 on 18x9 radial wheel from e38 with offset of 22 and it rub inside the tire well. on 92 525iT.

Running E34 M5 Euro 17x9 on the rear, believe ET22, shod with Pirelli 265/40/17 and no problems. Previous Style 32's would have rubbed. Those wheels are ET26. So, it depends on your wheel, your car, the ET, and there is a difference between brands of tires as well.

so I am assuming the rubbing occurs on the inner side of the wheel. Because you said your wheels with the greater offset clear where the other ones didn't?

i run 255 40 17 on 17x10 and no rubbing -- but i had my fenders rolled -- about 70 euros, but probably much cheaper if you're in the states
